11-month rent agreement: format and essentials
In India, most residential rent agreements are made for 11 months. Here is why, what the agreement should contain, and how to prepare one quickly.
Why 11 months?
Under the Registration Act, leases for more than a year (and year-to-year leases) generally must be registered, which means paying registration fees and higher stamp duty and visiting the sub-registrar’s office. An 11-month agreement usually avoids compulsory registration, and owners and tenants simply renew it. Rules differ by state, and some states encourage or require registration, so check locally.
Clauses every rent agreement should have
- Names, parentage and addresses of owner and tenant.
- Full address of the property.
- Monthly rent, due date and payment method.
- Security deposit and when it will be refunded.
- Start date and term (for example 11 months).
- Maintenance and utility bills — who pays what.
- Notice period for either side and any lock-in period.
- Rent increase on renewal.
- Use of the property, subletting and repairs.
- List of fittings and furniture included.
- Signatures of both parties and two witnesses.
Stamp paper and e-stamping
The agreement is printed on non-judicial stamp paper (or e-stamp certificate) of the value your state prescribes, often a small fixed amount for short residential leases. Many states offer e-stamping through authorised centres or online.

Questions
Is a rent agreement on plain paper valid?
An unstamped agreement may not be admissible as evidence until stamp duty and penalty are paid. Using the correct stamp paper avoids that.
Do I need police verification?
Many cities require owners to get tenants verified with the local police. Check your city’s rules.
